Guthrie Supports Bill Providing Flexibility for Overtime Workers

Congressman Brett Guthrie (KY-02) today voted in support of H.R. 1406, the Working Families Flexibility Act of 2013.

Washington, DC– Congressman Brett Guthrie (KY-02) today voted in support of H.R. 1406, the Working Families Flexibility Act of 2013.  This bill would give employees the ability to choose – on a voluntary basis – whether they would like to take their overtime pay in cash or as additional time off. Under current law, employees do not have the flexibility to do this.

“This is a bill to empower families to choose what works best for them,” said Congressman Guthrie. “Whether it’s taking comp time to attend your child’s little league game, caring for an elderly parent, or having overtime pay to use for your family’s bills, the Working Families Flexibility Act allows you to have the choice of how you are compensated for your extra hours.”

H.R. 1406 would require that employees who elect to be compensated with additional comp time be rewarded at a “time and a half” rate, exactly as they would be if they took their overtime pay in cash. It also preserves established oversight and recourse to check unlawful employee coercion.

“It’s 2013 and American workers and their families are facing challenges that the Fair Labor Standards Act never could have foreseen. Working adults, particularly parents, are facing an increasing number of demands and this legislation will give them more flexibility to meet them,” added Congressman Guthrie.

“This bill puts the choice entirely in the hands of the employee. Who else is best equipped to decide how to spend your time?” asked Congressman Guthrie.
